Terms of Service

1. Agreement to these terms
These Terms of Service (the “Terms”) form a binding agreement between you and Trismegistus (“Trismegistus,” “we,” “us”) and govern your access to and use of the Trismegistus platform, websites, APIs, and related services (collectively, the “Service”). By creating an account, purchasing credits, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What the Service does
Trismegistus lets you compose and run “Entities” — configurations that route a prompt to one or more third-party artificial-intelligence models and blend, rank, or synthesize their outputs into a single result. The underlying models are operated by third-party providers (for example, model gateways and generation providers). We orchestrate calls to those providers on your behalf; we do not create or control the models themselves and we do not guarantee any particular output.
3. Accounts and eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Credits, plans, and billing
The Service is priced in credits, which are spent as you use AI features. You may obtain credits through a one-time purchase (credit packs, which do not expire) or through a monthly subscription plan that grants a recurring credit allotment. Each run consumes credits based on the models used and a per-tier multiplier disclosed in the app. Purchases are processed by third-party payment processors; by purchasing, you also agree to their terms. Except where required by law, purchases and subscription fees are non-refundable. Subscriptions renew automatically until cancelled; you may cancel at any time from your account, and cancellation takes effect at the end of the current billing period. We may apply daily and weekly usage limits and other safeguards to protect against runaway or abusive usage.
5. Acceptable use
You agree not to use the Service to: (a) violate any law or the rights of others; (b) generate or distribute content that is unlawful, harmful, harassing, or infringing; (c) attempt to reverse-engineer, disrupt, or circumvent the Service’s security, rate limits, or billing; (d) resell or provide the Service to third parties except through features we expressly provide; or (e) use the Service in a manner that violates the usage policies of the underlying model providers. We may suspend or terminate accounts that violate these Terms.
6. Your content and generated output
You retain ownership of the prompts, files, and other materials you submit (“Input”). You grant us a limited license to process your Input as needed to operate the Service, including transmitting it to the third-party model providers required to fulfill your run. Subject to these Terms and the applicable providers’ terms, you own the output your runs generate (“Output”). You are solely responsible for your Input and for how you use any Output. AI-generated Output may be inaccurate, incomplete, or offensive; you must review it before relying on it, and you must not present it as professional (legal, medical, financial) advice.
7. Third-party providers
The Service depends on third-party model, payment, and infrastructure providers. Your use of the Service is also subject to those providers’ terms and policies, and their availability, pricing, or behavior may change in ways outside our control.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any Output will be accurate or suitable for your purposes.
9. Limitation of liability
To the maximum extent permitted by law, Trismegistus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US$100.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if required to protect the Service or other users. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
